Terms of service
Version 1. Last updated: 2026-11-01.
These terms are the contract between you and Miriam Blanco for AlphOne Pro. Some parts apply only to consumers: people who buy for purposes outside their trade, business or profession, and associations or other groups that act without profit outside any commercial activity. Nothing in these terms takes away a right that consumer law gives you.
1. Who we are
- Seller: Miriam Blanco, trading as AlphOne Pro
- City: Ciudad Real
- Email: support@alph.one
- Phone: (+34) 668 818 898
2. The service
- AlphOne Pro is a hosted subscription to AlphOne, a customer relationship manager (CRM) whose source code is public. The hosted service adds our own code. We run it for you over the internet. Nothing is shipped.
- Each subscription gives you one private workspace with as many staff accounts as you need. Each account needs an email address not used in any other workspace.
- In your workspace you keep contacts with custom fields, tasks and spreadsheet imports. A long text custom field can hold notes.
- WhatsApp messaging does not work in AlphOne Pro yet (section 8).
- We keep the software updated and backed up (section 10). You use it in a current web browser.
- Some records cannot yet be deleted inside the app: contacts, tasks, conversations, messages and media, imports, staff accounts and custom field definitions. We delete them for you within 30 days of your request.
3. Signing up
- Type your email address on the pricing page.
- We email you a link. It works for 24 hours. If you typed a wrong address, the link never arrives, so type it again.
- The link opens a checkout page run by Stripe, our payment provider. You enter your card and billing details there. We never see your card. Check your details and correct any mistake before you pay.
- You tick the box to accept these terms, and you pay. The contract is made when Stripe confirms your payment, and these terms are part of it.
- You name your workspace. We email you an invitation to set your password. This normally takes a few minutes.
- Your subscription starts when you pay, even if you name your workspace later.
- If we take your payment but cannot create your workspace, we write to you within one business day. You then get your workspace or a full refund.
- Within one day of your payment, we email you a copy of these terms and the withdrawal form.
- We keep a record of your purchase and of every version of these terms. Ask us and we send you the version that applied to you.
- These terms, the order pages and our automatic emails are in English.
- You must be 18 or older to buy.
4. Price, taxes and payment
- There is one plan, billed monthly in the currency shown on the pricing page.
- The price on the pricing page does not include VAT. Stripe Checkout adds VAT where we are registered to collect it, based on your country and any tax ID you give, and shows you the final price before you pay.
- We sell to buyers in any country, unless sanctions or export rules forbid it.
- You pay by card through Stripe. We charge the first month when you buy, then on the same day each month.
- Promotion codes: a code's conditions are shown where you get it and at checkout. When a discount ends, the normal price applies. If a code makes the price zero, checkout may not ask for a card, so add one in the billing portal before the discount ends.
- Price changes: we raise the price only when what we pay for hosting, backups, email or payments goes up, or when a tax is added or raised. We email you at least 30 days before, with the reason. The new price applies from your first monthly payment after that. If you do not agree, cancel before then, at no cost.
- Failed payments: Stripe tries your card again over the following days and we email you, while your workspace stays on. With no card, or if every try fails, your workspace is switched off. Pay the open invoice in the billing portal and it comes back on by itself.
5. Duration, cancelling and refunds
- Your subscription has no end date. It runs month by month until you cancel. There is no minimum term and no fee to cancel.
- To cancel online, open the link in the first confirmation email we sent you. It opens your workspace page. Press "Email me the billing portal link", open the link we send within 24 hours, and cancel in the billing portal.
- Or write to support@alph.one from the email address you subscribed with, and we cancel for you.
- Cancelling takes effect at the end of the month you paid for. Your workspace works until then.
Refunds:
- Cancelling does not refund the rest of the month.
- You get a full refund if you withdraw within 14 calendar days (section 6), or if we take your payment but cannot create your workspace (section 3).
- You get back the days you paid for and did not get if we end the contract (section 7) or if you leave over a new sub-processor (section 12).
- A consumer can also get money back when the service is not in conformity (section 14) or when it gets worse (section 15).
- We refund to the card you paid with, in the currency you paid.
6. Right of withdrawal
Consumers have this right by law on every new subscription. We give the same right to a business on its first subscription.
Right of withdrawal:
- You have the right to withdraw from this contract within 14 calendar days without giving any reason.
- The withdrawal period ends 14 calendar days after the day the contract is made.
- To withdraw, tell us your decision with a clear statement, for example an email. Our details: Miriam Blanco, (+34) 668 818 898, support@alph.one. You may use the model form below, but you do not have to.
- To meet the deadline, it is enough to send your message before the withdrawal period ends.
Effects of withdrawal:
- If you withdraw, we refund all payments we received from you, without undue delay and at the latest 14 calendar days after the day you tell us. We refund to the card you paid with. The refund costs you nothing.
- You pay nothing for the days you used the service.
- We cancel your subscription at once and archive your workspace (section 11). You can still ask for an export of your data.
Model withdrawal form. Fill in and send this form only if you want to withdraw from the contract.
- To: Miriam Blanco, support@alph.one
- I hereby give notice that I withdraw from my contract for the following service: AlphOne Pro, workspace name:
- Ordered on:
- Name of consumer:
- Address of consumer:
- Signature of consumer (only if this form is sent on paper):
- Date:
7. Acceptable use
You are responsible for your workspace and for what your staff do in it. Keep passwords and API tokens safe. You must not:
- store or send anything unlawful, or anything that infringes other people's rights
- send spam, or messages people did not agree to get
- message people on WhatsApp without the opt-in Meta requires, or break WhatsApp's business policies or Meta's other terms
- try to reach other workspaces, test or break our security, or get around limits
- overload the service with automated traffic far beyond normal use
What we do when a rule is broken:
- We do not scan your content. We act on reports, on orders from authorities, and on problems we see while running the service. A person makes every decision.
- For a smaller breach, we warn you first and ask you to stop.
- For a serious breach, or if you do not stop after a warning, we end the contract. We cancel your subscription, refund the days you paid for and did not get, and archive your workspace (section 11).
- We email you what we did, why, and which rule or law it rests on. To challenge it, reply to that email. A person reviews your reply. You can also go to court.
8. WhatsApp
- WhatsApp messaging is not ready yet in the hosted service. You cannot send or receive WhatsApp messages in AlphOne Pro today, and it is not part of what you pay for.
- We take no WhatsApp keys until it is ready. When it is, we email every customer and these terms say how it works, with 30 days of notice as section 15 describes.
9. Support and complaints
- Email support@alph.one, in English or Spanish. We normally answer within one business day.
- Phone (+34) 668 818 898.
- To complain, email us or call us. We give you a reference number and a written receipt, and we answer within 15 days at most.
- We have not joined a consumer dispute resolution body. If we cannot solve your complaint, we tell you which body can handle it and whether we will take part.
10. Availability and backups
- The service runs on one server, with no promised uptime. A fault or maintenance can stop it for a while.
- We back up the databases every night and before each update, and keep each backup for 30 days.
- Backups are for recovering the whole service after a failure. We do not restore a single workspace to an earlier day. If the server fails, data added since the last backup can be lost.
- Nothing in this section limits your rights in section 14.
11. When your subscription ends, and your data
When you cancel, withdraw, a payment fails for good, or we end the contract:
- Your workspace is switched off. Nobody can sign in or change anything.
- Until we archive the workspace, people already signed in can still read for up to 30 days, and API tokens and webhooks keep working. We archive it at once when you ask, when you withdraw, and when we end the contract.
- We keep your data for 12 months so you can come back. Subscribe again with the same email address within that time and you get your workspace back with everything in it.
- After those 12 months we delete your workspace and everything in it. Backups that hold it are removed about 30 days after that.
- You can ask us to delete it sooner. We then delete it within 30 days.
Your data and leaving:
- You can ask for an export of your workspace at any time, during your subscription or in the 12 months after it. It is free. We send it within 30 days of your request, as files in common machine-readable formats such as CSV and JSON, with a list of the files and what each one holds.
- While your subscription runs, you can also read your data free through the AlphOne API with a token.
- The export holds all the data in your workspace: contacts and their details, custom fields and their values, tasks, WhatsApp conversations, messages and media, imports, staff accounts and their roles, webhooks and settings. For security it leaves out password hashes and secret tokens. We keep nothing back as a trade secret.
- To move to another provider or to your own AlphOne server, tell us. There is no notice period and no switching fee. We help you plan the move and tell you of any risk we know. Your contract stays in force and your workspace keeps running until the move is done, so do not cancel first.
- If a move within 30 days is not technically possible, we tell you within 14 working days of your request, with the reason and a new date at most 7 months away. You can extend the move period once, for as long as you need.
- During the move we keep your data safe. When the move is done, we tell you, end the contract and refund the days you paid for after that.
- After your move your data stays available for at least 30 days, and until the 12 months end unless you ask us to delete it sooner.
12. Data processing terms
For the personal data in your workspace, you are the controller and we are your processor. This section is the contract that article 28 of the GDPR requires.
What we do with it:
- Subject and purpose: we host and run your workspace. We store, show, import and back up your data, send invitation and password reset emails, deliver webhooks to the addresses you set, and give support.
- Whose data: your contacts, leads and clients, and your staff.
- What data: names, phone numbers, email addresses, WhatsApp profile names, messages, media and delivery statuses, tasks, custom fields, imported spreadsheets and staff account details, plus anything you choose to type in.
- How long: while your subscription lasts, then as section 11 says.
Your instructions and duties:
- Your use of the app, these terms and your written requests are your instructions. We follow only them, unless EU or Spanish law requires something else. In that case we tell you first, unless that law forbids it.
- We tell you if we think an instruction breaks data protection law.
- You must have a legal basis for your contacts' data and for messaging them, sensitive data included. You tell them how you use their data and you answer their requests.
Our people:
- Only people who need it can reach your workspace, and they are bound to confidentiality.
- Our support staff enter it only when you ask, to fix a fault, to keep the service safe, or when the law requires it.
Security:
- All traffic to the service uses HTTPS.
- Passwords are stored only as one-way hashes.
- All workspaces share one database. The app keeps them apart, not the database itself.
- Backups are stored encrypted, with no public access.
- Our logs record events and errors, not visits.
Sub-processors. You give us general permission to use these sub-processors:
- Hetzner Online GmbH, Germany. Runs the server that holds the service and its database. Location: Finland.
- Amazon Web Services EMEA SARL, Luxembourg. Stores the backups. Location: Ireland.
- Resend (Plus Five Five, Inc.), United States. Sends invitation and password reset emails. Location: United States, under the EU-US Data Privacy Framework and the EU standard contractual clauses.
- Spaceship, Inc. Runs our domain and forwards email sent to support@alph.one. Location: United States, under the EU standard contractual clauses.
- Cyberlabs Inc.. Holds our support mailbox. Location: Delaware, USA.
About this list:
- Each sub-processor is bound by a contract with data protection duties that meet article 28 of the GDPR.
- We email your workspace administrator at least 30 days before we add or replace a sub-processor. You can object by email within that time. If we cannot meet your objection, you can end the contract and we refund the days you paid for and did not get.
- Meta is not our sub-processor. It works for you under your own contract with Meta. Stripe handles billing only and gets no workspace content.
Help, breaches and audits:
- We help you answer people who use their data protection rights.
- We tell you within 48 hours after we learn of a personal data breach that affects your workspace, and we give you what you need to report it.
- We give you the information you need for your security duties and impact assessments, and what shows we meet this section. You may audit us once a year with 30 days notice, at your cost, yourself or through an independent auditor bound to confidentiality. You may audit more often after a breach that affects your workspace or when a data protection authority asks.
- At the end of the service we return your data by export or delete it, as you choose (section 11).
Where your data is and who can reach it:
- Amazon Web Services and Resend belong to United States groups.
- To protect your data against access by a government outside the EU, we keep it in Finland with a German company, and the backups encrypted in Ireland.
- We give data to an authority only when EU or Spanish law requires it. If an authority outside the EU asks for it, we refuse unless an international agreement or EU law allows it. We tell you first, unless the law forbids it.
13. Reporting illegal content, and our contact point
Anyone can report content in AlphOne Pro that they think is illegal. Email support@alph.one with:
- why you think it is illegal
- where it is, as exactly as you can
- your name and email address, except when you report child sexual abuse material
- a statement that you believe in good faith that the report is accurate and complete
We confirm we got your report, decide with care, and tell you our decision and how to challenge it.
support@alph.one is also our single contact point for users and for EU and national authorities under the Digital Services Act. We answer in English or Spanish. A person reads every message.
14. Liability
If you are a consumer:
- We are liable as the law says. You have the legal guarantee of conformity for digital services. It covers what these terms describe and what you can reasonably expect of such a service.
- If the service is not in conformity, you can ask us to fix it. If we cannot fix it, do not fix it within a reasonable time, or the problem is serious, you can ask for a lower price, or end the contract and get back what you paid for the time it did not work. You can also claim damages as the law allows.
If you buy as a business:
- Our total liability in any 12 months is at most what you paid us in those 12 months.
- We are not liable for indirect loss, such as lost profit or lost business.
- These limits do not apply to harm we cause on purpose or by gross negligence, or where the law does not allow a limit.
For everyone: we are not liable for events we could not foresee or avoid, such as a failure of the internet. This does not limit a consumer's rights above.
15. Changes to the service and to these terms
- We may change the service to keep it secure, to follow the law, to add features, or to remove features few customers use. Changes cost you nothing extra.
- If a change makes the service worse for you in more than a minor way, we email you at least 30 days before. If you are a consumer, you can then end the contract for free within 30 days of our email or of the change, whichever is later. We refund what you paid for the time after the end.
- We may change these terms for the same reasons, or to explain the service better. A change that matters to you applies from your first monthly payment at least 30 days after we email you. If you do not agree, cancel before then, at no cost. Each version has a date (section 3).
16. Law and courts
- Spanish law governs these terms.
- If you are a consumer, you keep the protection of the mandatory law of the country where you live. You can bring a claim in the courts where you live or in Spain. We can sue you only in the courts where you live.
- If you buy as a business, the courts of Ciudad Real, Spain, decide any dispute, where the law allows this choice.
